Rule of 85
Rule of 85 refers to a transitional protection within the local government pension scheme whereby you may be able to retire before your retirement age without reduction to your pension.
You would satisfy the 85 year rule if:
- You were a member of the local government pension scheme before 30 November 2006
- You are age 60 or over
- Your protected membership plus your age in whole years adds up to 85 or more (partial protection if below age 60).
From 1 April 2020, there will only be partial protection available.
These changes will mainly affect those who were born after 1 April 1960 and those who were born before 1 April 1960 but who will be less than 60 years of age at retirement (retirement date being prior to 1 April 2020).
Your pensionable service can be divided into 3 parts;
| Pensionable Service | |
| Pre 1 April 2008 | Protected |
| 1 April 2008 - 31 March 2020 | Protected only if you will be 60 by 31 March 2020 |
| Post 31 March 2020 | Unprotected |
