The Decision
As Disciplining Officer you have to make a decision on the outcome of the hearing based on the evidence presented before you.
When arriving at your decision you should take into account the following:
- the severity of the allegation/misconduct;
- any existing disciplinary record;
- the employee's position and length of service; and
- any mitigating circumstances.
Once you have reached your decision, you should reconvene the hearing and advise the employee and their companion of the decision reached.
Written confirmation of disciplinary action being taken will be issued within 7 days of conclusion of the hearing and will contain advice as to the employee’s right of appeal, to whom any appeal should be submitted and the designated time limit. The Incident Report Form (PER/DCP/1/2015) should also be completed.
All documentation and correspondence must be collated and filed in the employee's personal file for future reference. This should include:
- A copy of the submissions.
- Copies of correspondence relating to the disciplinary hearing.
- Copy of the written confirmation of disciplinary action taken.
- The completed DCP 1 form.
